News is circulating that some insurance companies are refusing to pay for claims incurred from car accidents during the recent winter storms, calling the storms an "act of God." While there is an act of God exclusion in many insurance policies, it should not apply to accidents resulting from driving in hazardous conditions. In fact, the law is very clear that motorists need to adjust their driving for roadway conditions.
If a driver chooses to drive in icy conditions and causes an accident by sliding into another car, failing to stop in time or failing to maintain their lane for instance, that driver should be accountable for all damages resulting from their negligence and the insurance company should pay for any resulting property damage or injury to any persons.
